A. 안녕하세요. 법무부 출입국외국인정책본부입니다. 귀하의 질의 내용은 재외동포 자격소지자의 활동범위에 대해 문의하신 것으로 이해됩니다.

   재외동포 자격소지 동포는 단순노무행위에 해당하는 세부직업(법무부 고시 2010-297, '10.4.14) 58개직종과, 사행행위 등 선량한 풍속 기타 사회질서에 반하는 행위를 하는 경우, 기타 공공의 이익이나 국내 취업질서 등의 유지를 위하여 그 취업을 제한할 필요가 있다고 인정되는 경우를 제외하고는 취업활동에 제한을 받지 않습니다. 다만, 허용되는 취업활동이라도 국내법령에 의하여 일정한 자격을 요하는 때에는 그 자격을 갖추어야 합니다.

   다른 법령에 제한이 없다면 사업을 운영하는 것은 가능하나 본인이 발마사지 등을 하는 것은 허용되지 않습니다.

Q.I have an acquaintance who has F-4 visas. He wants to open a massage shop in Korea. Could you please let me know if he can open it? And if so, let me know about the related procedures as well.

 A. Thank you for your question. This is Korea Immigration Service, a Ministry of Justice-affiliated organization. We think what you want to know is the sphere of job activities of overseas Koreans who have licenses. Excepting 58 types of occupation falling under the category of simple labors(Notification No. 2010-297 of the Ministry of Justice, '10.4.14), and cases where it is against social order or good customs, or it needs to be restricted for the preservation of order of employment in the country, there are no restrictions as to their job activities. However, even though it comes under the allowable job categories, in some cases, a certain qualification may be required by domestic laws.

 Unless otherwise required by law, your acquaintance can run that business; however, personally giving a massage to customers is not permissible.
